The two paths to a granny flat in Sydney

There are two ways to get a granny flat approved in NSW: a Complying Development Certificate (CDC) under the State Environmental Planning Policy, or a Development Application (DA) through your local council.

CDC is faster — often 21 days — but your block has to meet the rules: minimum 450m², minimum 12m frontage, the right setbacks, and the right zoning. If you're outside those rules, you're going to DA.

We work out which path fits your block at the free site visit, then we own it from there.

Questions about this service.

Can I rent it out?

Yes. Granny flats approved under the SEPP are explicitly allowed to be rented out as a separate tenancy. You can advertise it on the same platforms as any other rental, and the rent does not need to go through the main dwelling.

How big can it be?

Up to 60m² of internal floor area under a CDC through the SEPP. Verandas, decks and patios sit outside that 60m² in most cases. Under a DA, councils sometimes allow more — we will tell you at the site visit which path gives you more usable space on your block.

Can I have a second storey?

Under the SEPP / CDC pathway, granny flats are limited to a single storey. If you want a two-storey secondary dwelling, it goes via DA and depends on your council's LEP and the character of your street. We will tell you straight whether your block and zone can support one before any plans get drawn.

How close to the boundary can it go?

CDC setbacks are typically 0.9m to side and rear boundaries for a 60m² granny flat, with stepped requirements for taller wall heights. DA setbacks vary council to council. We measure your block at the site visit and design to the actual numbers, not a guess.

What if my block is under 450m²?

You are outside the CDC pathway, but a DA may still get you there. We have approved granny flats on smaller blocks in several Sydney councils where the layout, setbacks and stormwater all stack up. Worth a free site visit before you write the idea off.
